EcoTrophy – Terms of Service

1. Acceptance of Terms

By accessing or purchasing from www.ecotrophy.in, you agree to comply with these Terms of Service (“Terms”), the Privacy Policy, and other linked policies.
These Terms are binding under Section 10 & 11 of the Indian Contract Act, 1872 (Lawful Consideration & Free Consent).
We may update these Terms at any time. Significant updates will be notified via email or website alerts.

2. Eligibility

  • Minimum age: 18 years (or consent from a legal guardian as per Indian Majority Act, 1875).

  • You must not use our services for unlawful purposes under the Information Technology Act, 2000.

  • You must not introduce viruses, malware, or harmful code (Section 66 of IT Act – Hacking/Computer Contaminants).

3. Our Rights

EcoTrophy reserves the right to:

  • Refuse service (as per Indian Contract Act – Freedom to Contract),

  • Limit or cancel orders suspected of fraud (Section 17 of Indian Contract Act – Fraud),

  • Change product prices or discontinue items without prior notice.

4. Products & Services

  • Images and descriptions are for reference; minor variations may occur (Consumer Protection Act, 2019 – Misleading Advertisements).

  • All products are subject to availability.

5. Billing & Order Accuracy

  • You must provide accurate billing and shipping details (Section 17, Indian Contract Act – Misrepresentation).

  • We reserve the right to cancel incorrect or suspicious orders.

  • Changes/cancellations will be communicated via the provided contact details.

6. Refunds & Cancellations

In compliance with the Consumer Protection Act, 2019:

  • Cancellations allowed before dispatch (except custom products),

  • Refunds processed within 2 business days of approval,

  • Custom-made items are non-refundable unless defective or wrong product is delivered (Section 2(47) – Deficiency in Service).

7. User-Generated Content

  • You retain ownership of your content (Copyright Act, 1957).

  • By submitting, you grant EcoTrophy a non-exclusive, royalty-free, revocable license to use the content for marketing or operations.

  • You confirm your content does not infringe third-party rights (Section 51, Copyright Act).

  • You may request removal of your content from our platforms.

8. Third-Party Links & Tools

  • Access to third-party services is at your own risk.

  • We are not liable for external site content (Section 79, IT Act – Safe Harbour).

9. Warranties & Limitations of Liability

  • Products are sold “as is” and “as available” (except where warranties are required under Sale of Goods Act, 1930).

  • Our maximum liability will not exceed the amount paid for the product (Section 73, Indian Contract Act – Compensation for Breach).

  • This limitation does not override statutory consumer rights.

10. Indemnification

You agree to indemnify EcoTrophy, its employees, and partners from claims arising from:

  • Violation of these Terms,

  • Infringement of intellectual property rights,

  • Breach of law.
    This aligns with Section 124 & 125, Indian Contract Act – Contracts of Indemnity.

11. Governing Law & Jurisdiction

  • Governed by Laws of India.

  • Exclusive jurisdiction: Courts in Chennai, Tamil Nadu (Section 20, Code of Civil Procedure, 1908).
